a helping hand in the face of tragedy. tonight we learn how a bay area ceo is reaching out to one of the victims of the aurora, colorado shootings. she comes from the tech sector. >> it's a story that comes down to two people who had never met but thanks to the company one of them runs they share a bond. and because of that bond, many of the victims are being helped. >> reporter: because of the racy content on its site, san francisco based zividy is watched closely forever -- >> it is personal to me. >> zividy's science manager sat down with us to talk about carly richards, she was shot inside the aurora theater and then rushed to the hospital. before carly went to the movie,

father's. na too was lost. >> to the latest on the deadly shooting including the package the fbi is now investigating. new tonight at 6:00, a 12-year-old boy is in the hospital in intensive care tonight after a tree fell on his tent during a bay area camping trip. the family was camping at memorial park in loma mar. the -- emergency workers say the 30 to 40-foot trunk appears to have truck the boy and then bounced off him. while it was windy in the park yesterday, it's not clear if that's what caused that tree to fall down. didn't the church look the other way? new evidence in the molestation case of -- highly working at trace child development center. it's a daycare connected to trace elementary school.

now a website is bashing the church for giving him a good recommendation. woodhouse was -- sexual assaulted a girl in a swimming pool and was fired from the church. nevertheless, a church supervisor wrote him in a positive review when he needed. the fire department is investigating a deadly fire this morning. the fire happened at a three-story apartment complex on. one man died in the fire, two others served from smoke inhalation, the two-alarm fire spread from the second floor and -- firefighters alerted people by knocking on doors and making phone calls. >> he let me know the building was on fire. he was in the apartment next door and he got a call also.

>> i heard the sirens and i looked out of the window, there was a solid wall of flames coming outf the left part of that building. >> the building suffered fire and water damage. the exact cause still under investigation. an alarming case of animal cruelty in monterrey county, 75 kittens found dead and more than 50 more cats rescued from two properties in seaside. the spca served search warrants today after receiving tips of numerous dead kittens on one of the properties. they found and seized 51 live cats -- they all suffer from respiratory infections, parasites and dental diseases. the investigation is ongoing and as of now, no arrests have been made. walmart is facing another class-action lawsuit, this time from disability rights

activists. that suit claims the retail giant refused to make payments to customers who -- knowingly placed the card swipe machines beyond a wheelchair's reach. well, environmentalists are vowing to fight governor brown's proposal to install a 37-mile tunnel beneath the sacramento delta. the governor joined for that announcement by u.n. secretary ken salazar. the twin tunnels would carry -- the governor says the pipeline would make the water supply more stable while protecting fish from the delta's pumps. >> we know very definitely about climate change and we know with the faster snow melt, that these levees can be overwhelmed and we also know the levees can't be fixed in the way some of the critics are recommending and we

also know the seismic threat is real. >> remember the movie "field of dreams" if you build it, they'll use it. build the tunnel and it will be used some day and it will be -- >> they say the pipeline would destroy delta habitats. fewer felons are skipping out on probation under the state's new realignment system. nearly 40,000 inmail inmates wed to could have been jails or released. under the new system, 4% of felons failed to report to their probation officers. under the old system, it was 14%. convicts have extra incentive to play by the rules, they can be released from supervision after three months if they don't have

new numbers out showing that californians rank at the bottom when it comes to taking care of children. next bay ye ne next. >> california kids are struggling, according to this report, each of the 50 states was ranked according to six different factor which contribute to a child's overall well-being. >> it's not easy being a kid in california. >> we were first out of 50, it's one thing to be number two or

three and not be number one, but no one wants to go around saying we're 41st. it really is a shame for this state. >> the golden state is failing in three of four areas, education, family and community, and economic well-being. >> in the sense that it's really hard for families to get out of poverty and that their choices and opportunities are constrained and their children are paying a price for it. that's what was most striking to me about the report. >> people in california use more of their income for housing than any other state which leaves less money for anything else. >> not just health care but foreclosures and cutting classrooms, cutting teachers, increasing class room sizes, there's huge issues for families across alameda county and across california state. >> people say the focus is on

kids, but with budget cuts it's been hard to keep critical services and one thing affects another. >> in alameda county, we lost 100 spots in the california state budget. so we know that that is what helps children learn and parents earn. >> many say the state needs to reprioriti reprioritize. and this serves as a major wakeup call. >> we're just like a family and we need to make tough choices in tough times. >> they're the ones who are going to lead our nation later on. so it's up to us to make sure we have a better future for our kids. >> california's best score came in for health care where we were ranked 23rd in the nation, coming in around the middle of the pack. >> it is distressing. job dropping information and how much taxpayers are spending to support junk food.

a nonprofit organization made the announcement at san francisco's u.n. plaza's farmer's market. it's apples to twinkies 2012 report. it says it's ultimately making america's childhood obesity problem worse. >> the rise in childhood obesity has many causes. one of the most important ones is the increased prevalence of high fat, highly sweetened jump food. >> last year, nearly $1.3 billion in taxpayer subsidies went to junk food ingredients. the total was more than 18 billion, that's enough to buy more than 3 billion twinkies each year. no fun and games here, shares of san francisco online gamer zynga tumbled by nearly

40% in after hours trading tonight. zynga's tumble follows a heart stops drop in shares in netflix today. also a rare stumble for apple. the company saw it's stock price chopped by 4.5% or $26 a share. california has one bright spot when it comes to the economy, the value of california's agriculture exports also grew by about $3 billion in 2011. the dark spot, a drought in the midwest is expected to drive up the cost of many foods for consumers across the country. an unusual request from the federal government issued to ship captains approaching the san francisco bay. slow down for whales. the request applies to large

ships which are known to collide with whales. the national oceanic and -- wants the ships to slow to about 11 miles an hour in waters where whales are seen. the request follows last month's death of a rare 47-foot fin whale which washed up near point reyes. our own jeff ranieri is saying slow down for the sunshine. take it in, enjoy. >> you heard me say that in the weather center? yes, slow down and enjoy it, we're going to have plenty of sunshine coming up and temperatures might be driving you crazy, because this weekend we did have upper 90s to near 100, and all of a sudden we're finding ourselves with 70s and 80s. 83 in livermore, and the willamette value. 74 in redwood city. now here is the thing about

today, an onshore flow is a lot stronger now than it has been over the past three days. many of you in san francisco no noticing that with cloud cover coming in. we're going to be impacted by some clouds here in the east bay for tonight. temperatures are cooling according accordingly with that onshore flow. let's get a look at the clouds in san francisco and you can see, you know, this time yesterday, we still had some sunshine, but today, you're just completely fogged in, at least at this current hour. we bring you back to the maps, it's not only for us, but for a good section of -- it looks like december out here and a lot of storm activity. but what we're taking a snapshot of is the lower level. so this is how expansive the fog is for california. if you're doing any traveling tonight, most of the fog in the northern san francisco peninsula and low clouds. we really think the north bay

will have more of that widespread low cloud cover for tonight and we can't rule that out even for the east bay. you can see at 6:00 a.m. for a thursday, a few low clouds expected back to oakland, fremont, not too much for san jose, but the peninsula will also begin with some low clouds and quite extensive for the north bay. a lot of that pushes back, so you're going to have some quick clearing for plenty of sunshine to slow down and enjoy as jessica was mentioning a little bit ago. on thursday, we're looking at some upper 60s inland. we'll see the largest jump by the afternoon in those interior valleys. here we go again, coming up in that seven-day forecast, ladies, we're going to talk about 90-degree heat, how long it's going to stay and most importantly when it's going to get here in a little while. >> okay, jeff. thank you so much. ahead at 6:00, a sweet smelling celebration.

ten staff members of a boy scout troop in san francisco, a gay scout says his sexual orientation was never a secret. the scout was fired for violating uniform guide lines wearing nail polish and an earring. other staff members started

wearing nail polish in support of him. the delay of chick-fil-a will not come in as planneded. information on the chick-fil-a website says the -- will now happen on july 16. the chain will move to mountain view by filing a zoning challenge. a challenge will be reviewed by the city council in september. the metropolitan transportation commission voted today to reject a $4 million in funding for a pilot project aimed at helping low income youth. dozens protested outside the building this morning. the hopes at the ntc would provide five million of it.

as violent crime continues to surge in the city of oakland, city leaders are urging resident to help take backary streets. the city's hoping to have a record 600 parties. so far 520 neighborhoods have agreed to participate in the august 7th event. the police chief says people need to be vigilant, not just it night but during the day too. >> we're not in this alone, the community really needs to be a part of it. i think they're finally getting tired of the violence and they're being held captive in their own community. >> last year residents hosted 560 parties, officials are hoping to break that record. san francisco's flower mart hosted what could be the most beautiful birthday party ever with color and fragrance everywhere you turn. the market is celebrating it's 100th anniversary with flowers of course. the market has changed a lot

over the decades thanks to rerefrigeration. >> the winter time, for example, january, february, we were down to about 10 or 15 different varieties of flowers. now we have thousands and thousands. >> the market was founded bark in 1912 and it was one of the few flower markets own it by growers. also coming up, not a smooth start, the mishap involving flowers at the olympics. why the fbi is now focussing on a package. and the plans for a mosque to be built in rural san martin are upward county approval, those against it are trying to have their voices heard.

the controversy over a proposed mosque in san mar teen is being protested. >> the people trying to build this mosque tell me right now they're using a barn as their place of worship and prayer, and that's why they're so determined to get this facility approved? they're facing some very vocal opposition. at nearly 16 acres, it's a serene and picturesque piece of land. that's where this islamic group wants to build a kmuchlt building. neighbors are worried it will disrupt their lifestyle. >> it's not who's coming, it's

just that will disrupt our quiet. >> if it was the catholic church moving in, you wouldn't like that either? >> no, i don't think so. >> a very systematic campaign of misinformation, completely trying to discredit the project and spreading rumors and fearmong fearmongering. >> their congregation of 80 to 100 families are in the area between morgan hill and gilroy. they're trying to build a place to practice their religion and to have a cemetery. >> we have exceeded the local requirements by at least 100%. we have not asked for a single variance at all. >> a group called gilroy morgan hill patriots is watching the

last week, mailed a notebook detailing his plans a few days before the attack. >> they're going to be saying what if for a long time. the contents of the notebook are highly interesting, but also the way it was found is somewhat unusual. a psychiatrist who was also a professor at the university of colorado aurora campus, thought he had been mailed a package from 21-year-old james holmes. police checked it out and it was deemed harmless. however upon checking that mail room, they did find a different package. it was addressed to the same professor and it was from holmes. the notebook reportedly details his plan for the ram page and includes drawings of the massacre that. notebook was reportedly sent days before the shooting but it

sat unopen in the mail room until police eventually discovered it and opened it up this past monday. also the first of the 12 people killed in the rampage was laid to rest. gord gordon -- his daughters were not hurt, but they did speak at funeral today. one daughter recalling in the disorientation and confusion, she could still hear her father saying i love you both. 20 of those people injured are still in the hospital and seven of them are in critical condition. a santa clara probation officer is recovering after accidentally shooting himself. it started around 8:15 last night on highway 17 in santa cruz when officers from the san jose police and chp pulled over a suspect wanted on a probation

violation. that officer was air lifted to a local hospital to be treated for nonlife-threatening injuries. this was the man officers were arrested when that happened. he's wanted by gilroy police and a million dollar felony warrant on -- the search is on for suspects who shot at a car with seven people including four kids inside. it happened on i-80 in hurricane coup lees late that is night. another man and four kids were in the back seat and luckily, they weren't hurt. right after the shooting, the car was driven to a nearby gas station where neighbors reacted. >> it's a little shocking because this area, we really don't have no shooting and that type of thing around here. >> do you know that it lapped as they were apparently driving on

80. >> that's moan -- more shocking. >> police have not released any information about the suspects. both of the victims are expected to be okay. five people were injured when a protest in anaheim, california last night. the protests were against two deadly police shootings over the weekend. several businesses were also looted. hundreds of police officers tried to control the crowd by using batons, pepper balls and bean bag rounds. officials say 24 people were arrested and five people suffered minor injuries including the media and officers. gop presidential nominee mitt romney arrived in london today and walked straight into

controversy when he said that obama, the president does not appreciate the country's relationship with great britain. the comment made by an unnamed advisor to a british newspaper said that obama doesn't understand the -- the obama administration responded calling the quote stunningly offensive. romney will attend the opening ceremonies at the olympic games friday before heading off to israel and poland over the weekend. the opening ceremony just two days away, but today the first day official competition and there's already some catastrophe. -- controversy. one of the athletes -- a picture of the south korean flag was shown on the jumbotron during player introductions, citizen of the north korean flag.

a greek olympic athlete has been kicked off the team after making what was seen as a racist slur on twitter. a triple jumper tweeted a joke making fun of immigrants from africa. the head of the greek olympic committee said it showed no respect for the olympics. the 23-year-old apologized saying that she was ashamed and did not want to offend anymore. a spokesperson for greece's co-ruling party says she can make as many vile jokes as she likes when she's watching the events on tv. there's only two days before the opening ceremonies. there's controversy and family strife in the jackson family. michael jackson's mother katherine is no longer the legal guardian of the king of pop's three children at least temporarily. t.j. is the son of michael's

thicker than it's been for the last few days. we had all that sunshine and the hot weather. seems like we sent all that over to london. of course just two days to go until those opening ceremonies where 10,000 athletes will be participating in representing 26 different sports, 204 countries and o let's get you the headlines for the morning hours, as we head throughout thursday, the numbers will be down a little bit more, but hold on, if you want the heat, we do have about a 10 to 20-degree spike in those temperatures. there's a high out here in the pacific. but eventually we will see it moving closer. but in the next 24 hours, we have to see it coming out here at the upper levels.

then at the lower levels, we're also contending with the fog on the coastline. marin will have temperatures anywhere from 50s to 670s, and back here for those interior valleys, 70s and 80s. things won't warm up until friday. as we begin, low 50s in the north bay. also low to mid 50s back in the south bay. 51 in san jose. jacket tonight, jacket in the morning. 80-degrees in san jose for that expected high. a mix of upper 70s and low 80s from danville back into livermore. and for san francisco, how's this, 67 for you, 74 in santa ro rosa. two days to go in the olympics. the forecast is looking better than it has in months a slight chance of showers, then by saturday, first day of full
